Public Offer Agreement

1. General Provisions

1.1. This agreement is an official proposal (offer) of the online store "FUSC CLOTHES" (hereinafter "Seller") to enter into a Purchase and Sale Agreement remotely, i.e. via the Online Store.

1.2. Information about goods displayed on the Website constitutes an invitation to make offers. Placing an order by the Buyer constitutes an offer to conclude a contract. The contract is deemed concluded upon confirmation of the order by the Seller (by sending a notification, providing a tracking number, or dispatching the Goods for delivery).

2. Subject of the agreement

2.1. The Seller undertakes to transfer the Goods to the Buyer's ownership, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

2.2. Products are presented on the website through photo samples that are the property of the online store.

3. Placing an order

3.1. The Buyer independently places an order in the online store through the "Cart" form.

3.2. When placing an order, the Buyer is obligated to provide accurate information about themselves (full name, phone, delivery address).

3.3. In case of out-of-stock items (inventory discrepancies, discovery of factory defects, etc.) or a technical/typographical error in the display of the price or characteristics of the Goods on the Website, the Seller has the right to unilaterally reject or cancel (void) the order, notifying the Buyer (by phone, messenger, or email). The Seller offers the Buyer: a) to purchase the Goods at the actual correct price; b) replacement with other available Goods of equivalent value or with price adjustment; or c) full refund of the paid funds to the Buyer within 1-7 banking days using the original payment method. Upon refund, all obligations of the Seller under this order are deemed fully terminated, and the Buyer is not entitled to claim damages, compensation, or purchase of goods at the erroneous price.

4. Product price and payment

4.1. Product prices are listed in Ukrainian national currency (hryvnia). The Seller reserves the right to unilaterally change prices until final order confirmation. In case of a technical glitch in price display, the provisions of clause 3.3 of this Agreement apply.

4.2. Payment is made in the following ways:

• Online payment by Visa/Mastercard card (via payment system).
• Cash on delivery at Nova Poshta branch (with or without prepayment, according to store terms).

5. Product delivery

5.1. Product delivery is carried out by "Nova Poshta" company.

5.2. Orders are shipped within 1-3 business days from the moment of order confirmation.

5.3. Delivery costs are paid by the Buyer according to the carrier's rates, unless otherwise stated (e.g., free delivery promotion).

5.4. The risk of accidental damage or loss of Goods during transportation rests with the carrier in accordance with applicable legislation. In the event of force majeure or damage/destruction of the parcel in transit (including hostilities, strikes, fires at carrier terminals, etc.), upon confirmation of destruction or loss by the carrier, the Seller will issue a full refund to the Buyer or, by mutual agreement, reship the order.

6. Product returns

6.1. The Buyer has the right to return goods of proper quality within 14 days, not counting the day of purchase, provided that the goods have not been used and their commercial appearance has been preserved.

6.2. Return shipping costs for goods of proper quality are borne by the Buyer.

7. Liability of the parties

7.1. The parties are liable for non-performance or improper performance of the terms of this agreement in the manner provided for by this agreement and the current legislation of Ukraine.

7.2. The Seller is not responsible for changes in product color depending on the Buyer's monitor settings.

8. Force Majeure

8.1. The parties shall be released from liability for partial or complete failure to perform obligations under this Agreement if such failure resulted from force majeure events occurring after the conclusion of the Agreement, which the parties could neither foresee nor prevent by reasonable measures.

8.2. Force majeure includes: military operations, armed conflicts, missile and artillery strikes, drone attacks, fires, accidents, natural disasters, prolonged power outages, telecommunications or banking network failures, and governmental decisions preventing performance of obligations.

8.3. The occurrence of force majeure extends the term for performance of obligations for the duration of such circumstances. If such circumstances persist for more than 30 calendar days, either party may terminate the Agreement unilaterally, and the Seller shall issue a full refund for undelivered Goods.
